If you have a problem with your neighbour’s tree and you want the removed, you must address the matter initially with the property owner where the tree is located.
If the owner does not share your view, you may need to obtain a report from an arborist or an engineer to substantiate your case with the neighbour or seek mediation through a Community Justice Centre or obtain legal advice.
Permission must be obtained from the owner of the tree and the owner must sign the application, prior to a request being made to Council for consent to remove a tree. Applications for removal of trees can only be lodged by the owner, agent or Strata Management of the property where the tree is located. In the case of multi-unit dwellings the corporation seal must be placed on the application.
A neighbouring property owner may however, apply to prune overhanging branches from a tree on an adjoining property. The tree owner must be notified that such an application is to be submitted to Council.
Residents are advised that Council has no power to compel a tree owner to prune or remove a tree. In the first instance residents are advised to consult their neighbours about the problem. Sometimes a dispute may arise between neighbours about removal or pruning of a tree and who should pay the cost of this work. Council has no authority over neighbourly disputes and this is a mater between residents. If you cannot resolve a dispute amicably, contact the Community Justice Centre or your solicitor.
